When I return to active status from inactive or retired status, do I need to complete credits?

Supreme Court Rule(s) cited in this FAQ: Rule 791.

Yes, unless you have an exemption from the MCLE requirements for the reporting period in which you return. When you return to active status from either inactive or retired status and are on active status on the reporting period's last day, you must complete the full requirements for the reporting period in which you return to active status. This is true even if you return to active status late in the reporting period.

We encourage you to read Rule 791(a)(3)-(7) to determine whether you are eligible for another exemption not based on inactive or retired status.

Here are your options for extending the time to complete your credits upon return to active status:
  1. report “Not Yet Complied” by your reporting deadline and get another 61 days to complete your credits, report compliance and pay a $100.00 late fee;
  2. report nothing by your reporting deadline and you will still get another 61 days to complete your credits and report compliance but the late fee due will be $250.00;
  3. if illness, financial hardship or other extraordinary or extenuating circumstance prevents you from completing your credits after returning to active status and your return to active status could not wait until a new reporting period began, you may apply for an exemption or extension.
